TERMS & CONDITIONS
Our terms and conditions of enrolment allow us to provide a service that is fair to you, to other students, to our staff, and to the Academy as a business.
Definitions
Account Holder means the person who is responsible for the enrolment and payment for the Student. The Account
Holder may also be the Student, as is the case with adult students.
Census Date means the last day on which You can terminate Enrolment without any further payment obligations.
Enrolment means the formal engagement of our services.
Student means the individual receiving the services provided by Us and for whom the Account Holder is responsible.
Teacher and Teachers means an employee who provides the services to the Student.
We, Our and Us means Advantage Music Academy Pty Ltd, including its employees.
You and Your means the Account Holder.
The key terms and conditions are shown below and have been written in consumer-friendly language.
Enrolment
When you enrol, you enrol with the Academy as an institute, not with a teacher as a private individual. The minimum length of enrolment is one term or the remainder of a term if you enrol midterm. Enrolment automatically renews from term to term, including from term 4 of one year to term 1 of the next year. The term dates are those published on our website.
Fees & Payment
Fees are paid via direct debit. The only other option is to pay for 4 terms upfront for which we invoice for card payment or direct transfer. Otherwise, you have to pay either in monthly instalments or quarterly for each term upfront via direct debit. Any fee increases are announced before the census date of the term from which the increase will take effect.
Limitation of Liability
We are not liable for an unsatisfactory learning outcome if the student does not adhere to the teacher's instructions and attend their schedule lessons, or if you do not disclose any behavioural, medical, or learning disabilities or disorders that may impact the student's ability.
Lessons
Enrolment entitles the student to a lesson on the day and at the time and frequency for the length of each term of enrolment as indicated in your enrolment form or as otherwise varied and agreed upon in writing in the course of enrolment.
You can request to change your regular lesson at any time. If we are unable to fulfil your request and you are consequently unable to maintain your enrolment, our terms and conditions of termination of enrolment apply.
Lessons missed by the student will not be rescheduled irrespective of the reason. If the teacher is unwell, lessons will be conducted online at our discretion. If we cannot provide a scheduled lesson, we will try to reschedule but if you can't make the alternative lesson, we will credit your account. If the student arrives late for a lesson, that lesson will finish at the scheduled time. If the teacher is running behind, the student will receive the length of lesson to which they are entitled.
Teachers
You enrol with the Academy as an institute, not with a teacher as a private individual. If your usual teacher is absent for any reason, we may have one of our other teachers take the lesson. At some point, like in every business, staffing arrangements will change. Someone might leave or we may restructure our operations. When this happens, your enrolment is maintained.
Your teacher reserves the right to instruct parents or guardians of children to remain outside the room if your teacher feels the parent or guardian is interfering with their ability to teach effectively.
Teachers reserve the right to refuse a lesson if a student is demonstrably sick, uncooperative, or abusive towards anyone or deliberately damages Academy property
Communication
We communicate with the primary account holder. We do not recognise communication via text message. We will send a text message only if there is an urgent message that affects multiple people. This will be accompanied with an email. All communication is centralised. Teachers will not exchange personal contact information. Teachers cannot discuss any administrative matters.
Termination of Enrolment
If you need to withdraw for any reason, you have to notify us by completing a short form by the relevant census date to avoid further charges. If for any reason you have to withdraw midterm, your payment obligations for the remainder of that term remain. We reserve the right to terminate a student's enrolment without a refund if you fail to meet your payment obligations, and if you, the student, or anyone in your care cause damage to our property or cause serious or repeated hinderance of any kind to our teachers or other students. We will manage any child's behavioural issue with parents but we will not tolerate damage to our property or aggression toward others - this applies to siblings in the waiting area, too.
If the student misses three consecutive lessons without any communication, we may terminate enrolment without a refund.
